Terms of Service

These Terms of Service ("Terms") are an agreement between you and Color Play AI LLC ("Color Play AI", "we", "us"). They govern your use of the Color Play AI website and service (the "Service"). By creating an account or accepting these Terms when prompted, you agree to them and to our Privacy Policy.

1. What the Service is

Color Play AI generates printable coloring pages from text descriptions and photos you provide, using third-party AI models. Generation is powered by credits you purchase or receive from us.

2. Who can use it

You must be at least 16 years of age to create an account. If you are under 18, you may use the Service only with the permission of your parent or legal guardian. By giving that permission, the parent or legal guardian agrees to these Terms and is responsible for the minor's compliance with them — including all activity on the account, content submitted, and purchases made. If you create profiles for children or upload photos of them, you do so as their parent or legal guardian (or with the consent of one).

3. Your account

You sign in through our authentication provider. You are responsible for activity on your account and for keeping your login method secure. You may close your account at any time by contacting us at info@colorplayai.com; normal refund rules (Section 5) apply to remaining credits.

4. Credits

• Credits are a prepaid means of using the Service. They are not currency or stored value, have no cash value, and are non-transferable. One credit generates one coloring page.
• Purchased credits never expire.
• Free, trial, and promotional credits may carry an expiration date disclosed when granted, are consumed before purchased credits, have no cash value, and are never refundable. One free trial per person.
• If a generation fails, the credit it consumed is automatically returned to you.
• We may change credit pack prices at any time; changes never affect credits you already hold.

5. Payments, refunds, and chargebacks

Payments are processed by Stripe. Except where the law requires otherwise:

• All purchases are final. However, if you have used none of the credits in a pack, you may request a full refund of that pack within 14 days of purchase.
• Beyond that, we may issue refunds at our discretion.
• Refunding a pack revokes its remaining credits.
• If you dispute a charge with your card issuer, the remaining credits from the disputed pack are revoked, and we may suspend your account while the dispute is open or if disputes recur.

6. Acceptable use

You may not use the Service to create, upload, or request:

• Content that infringes anyone else's intellectual property — including prompting for trademarked or famous characters, brands, or franchises (e.g., characters from movies, TV, or games);
• Images of a real person without that person's consent (for minors, the consent of a parent or legal guardian);
• Child sexual abuse material of any kind, or any sexualized depiction of minors;
• Non-consensual intimate imagery, or deceptive "deepfake" depictions of real people;
• Content that is illegal, or that promotes hatred or violence against people.

Color Play AI is a family-friendly service. We may refuse to generate, or remove, any content at our discretion, whether or not it is listed above.

You also may not:

• Access the Service by scraping, bots, or other automated means;
• Resell the Service or offer it to others as your own service;
• Use generated images or any part of the Service to train AI models;
• Circumvent usage limits. We may impose reasonable rate and usage limits and may change them at any time.

7. Enforcement

• For most violations we will remove the content and warn you; repeated violations may lead to suspension or termination.
• Serious violations — child sexual abuse material, other illegal content, or non-consensual intimate imagery — result in immediate termination, and we report such material where required by law.
• Repeat copyright infringement results in termination (see Section 10).
• If your account is terminated for cause, remaining credits are forfeited and are not refunded except where the law requires.

Closing your account voluntarily is not a for-cause termination; normal refund rules (Section 5) apply.

8. Your content and who owns what

• Your inputs stay yours. You retain all rights in your prompts and the photos you upload.
• Generated pages are yours to use. As between you and us, and to the extent permitted by applicable law, you own the coloring pages you generate. We assign to you all right, title, and interest, if any, that we may have in them. You may use them for any purpose, including commercial use.
• Honest caveats: AI-generated images may not be protectable by copyright under applicable law, and we make no promise that you can register or enforce rights in them. Similar or identical images may be generated for other users; our assignment to you does not cover other users' images.

License you give us. So we can run the Service, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, and convert your prompts, uploads, and generated pages; to transmit them to the service providers that power the Service (including fal.ai, our third-party AI processor); to display them to you within the Service; and to use them for moderation and abuse review. We may sublicense these rights to our service providers only — no one else. No image is kept forever: uploaded photos are deleted when you delete them or your account, and generated pages are deleted with your account. When you delete content, we stop displaying it immediately and permanently delete stored copies within 45 days; this license ends when the content is permanently deleted, except for temporary cached copies and copies we must keep to comply with law. We do not use your content to train AI models and do not claim any broader rights over it.

Your promises to us. You represent and warrant that: you are at least 16 years old and, if under 18, have the permission of your parent or legal guardian to use the Service; you own or have the necessary rights to everything you submit; you have the consent of every person depicted in photos you upload (for minors, the authority of a parent or legal guardian); and your content does not infringe third-party rights or violate law or these Terms.

9. Indemnity

You will indemnify and hold us harmless from claims, damages, and expenses (including reasonable attorneys' fees) arising from content you submit or your breach of the promises in Section 8.

10. Copyright complaints (DMCA)

If you believe content on the Service infringes your copyright, send a notice to our designated agent: email info@colorplayai.com. Your notice must include the elements required by 17 U.S.C. § 512(c)(3): identification of the copyrighted work, identification and location of the allegedly infringing material, your contact information, a good-faith statement, a statement of accuracy under penalty of perjury, and your physical or electronic signature.

We will remove or disable access to material identified in valid notices. If your content is removed and you believe it was a mistake, you may send a counter-notice with the elements required by § 512(g)(3); we will follow the statutory counter-notice process. Knowingly misrepresenting that material is infringing (or was removed by mistake) can make you liable for damages under § 512(f).

Repeat infringers' accounts are terminated.

11. Disclaimers

The Service and everything it generates are provided "as is" and "as available", without warranties of any kind, express or implied — including merchantability, fitness for a particular purpose, non-infringement, and originality of generated images. AI output is unpredictable; we do not guarantee any particular result, availability, or that generated images will be free of third-party claims.

AI output and mature content. We put safeguards in place to keep generated content family-friendly, but AI models are inherently unpredictable, and no set of guardrails can anticipate every possible output. Despite our efforts, the Service may occasionally produce images that are unexpected, inaccurate, or that some users consider mature, disturbing, or otherwise inappropriate. To the maximum extent permitted by law, we are not liable for any mature or otherwise objectionable content the AI models may generate, and you use AI-generated output at your own discretion. Parents and legal guardians who permit a minor to use the Service accept this risk on the minor's behalf and should review generated content before sharing it with children. If the Service generates something inappropriate, please report it to info@colorplayai.com so we can improve our safeguards.

12. Limitation of liability

To the maximum extent permitted by law, our total liability for all claims arising out of or relating to the Service is limited to the amounts you paid us in the 12 months before the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, or lost profits or data. Some jurisdictions do not allow certain limitations; in those, our liability is limited to the fullest extent permitted.

13. Changes to these Terms

We may update these Terms. If we make a material change, we will show you the updated Terms the next time you sign in and ask you to accept them. You must accept to keep using the Service. Non-material updates are reflected in the Last updated date above.

14. Governing law and disputes

These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Utah, and you consent to their jurisdiction.

15. General

If any provision of these Terms is unenforceable, the rest remain in effect. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Service. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. Our failure to enforce a provision is not a waiver.
